Trevor Brennan on Sky TV tonight

T Brennan was co commentator with Scott Hastings on tonight's Toulouse v Glasgow game on Sky TV. I was under the impression that he had been "banned from any involvement in future ERC competitions" by the ERC.

Am I missing someting here?

He was banned from participating in ERC Tournaments.

Commentating isn't participating.

Wrong. Brennan was banned from any involvement in future ERC competitions. "Involvement" includes commentating at a game.

Wrong. Read the decision of the appeal committee.

"banned from participating in any capacity in future competitions organised by ERC for a period of 5 years commencing 1st June 2007."

Commentating isn't participating. For example, there is nothing stopping him going to games as a spectator, writing articles about them or commentating.

Commentating on a ERC game for Sky Sports is participating in "any" capacity and is clearly different from attending a game as a spectator.

Rubbish. Participating means playing, coaching or doing another role for a team participating in the competition. Teams involved in the ERC sign a participation agreement. Commentating is talking about the competition - it isn't participating. The ERC can't ban someone from talking about their competition and they have absolutely no power to prevent Sky or any other news organisation employing whom ever they want.
