Brennan gains High Court injunction against disciplinary hearing

15:41 Wednesday January 31st 2007

The High Court has granted a temporary injunction to Irish rugby player Trevor Brennan, adjourning a disciplinary hearing into an alleged punching incident during a match ten days ago.

The Dublin based European Rugby Club was due to hold the hearing tomorrow but it has been deferred pending the outcome of the Stade Toulouse player's High Court action.

Lawyers for Mr Brennan this afternoon told the court they feared criminal proceedings he's facing could be prejudiced by the hearing.

They want it adjourned completely until after the criminal action is over.

It's alleged he punched an Ulster fan during a Heineken Cup match in France.

Maybe Paddy has, or another supporter in the near facinity. Brennan assaulted someone in a crowded stand, not unfeasible that his elbows hit someone! :?

TREVOR BRENNAN MISCONDUCT COMPLAINT

The independent Disciplinary Committee hearing, scheduled to hear the Misconduct complaint against Toulouse player Trevor Brennan in Dublin tomorrow (Thursday, 1 February, 2007), has been postponed following an application by the player's representatives for an injunction to delay the hearing.

The player was due to answer a Misconduct complaint arising from the Round 6 Heineken Cup Pool 5 match against Ulster Rugby at Stade Ernest Wallon on Sunday, 21 January.

The complaint, under the Heineken Cup 2006 / 2007 Disciplinary Rules, is that he allegedly entered one of the seating areas of the stadium and assaulted a spectator during the Toulouse and Ulster Rugby match.

GARETH THOMAS MISCONDUCT COMPLAINT

The independent Disciplinary Committee hearing involving Toulouse player Gareth Thomas remains scheduled for tomorrow (Thursday, 1 February, 2007) in Dublin.

Interesting that it says criminal proceedings

I thought that the French authorities weren't going to pursue anything so if Patrick Bamford wanted to take things further, it would be a civil case rather than a criminal case.

Maybe I'm reading too much into the wording.

Handy bit of work by Mr Brennans Lawyers. He will now be able to play out the season and will be retired by the time he gets banned.

His club should have suspended him straight away pending the outcome of any investigations, but I'm not surprised in slightest that toulouse havent done so. Not too impressed by their approach so far and I doubt that UR will be either.
